Employee files lawsuit after bosses ridicule her for celebrating Thanksgiving

Promila Awasthi, an Indian-born American citizen who works at Infosys as a computer consultant, filed a lawsuit on Monday that accuses her bosses of subjecting her to a hostile work environment that included being ridiculed Awasthi for celebrating American holidays like Thanksgiving and not being compensated for overtime hours worked.

Awasthi, who worked at the Infosys office in Fremont, CA from February to November 2008, described the working conditions there as being “intolerable.”  Infosys is one of the large India-based technology outsourcing companies that has recently been expanding its presence in the US to try to halt criticism that these firms are outsourcing American jobs overseas.

The lawsuit alleges that Infosys bosses routinely criticized Americans, including Awasthi, for not having “family values,” and they stated that layoffs in America are good because those jobs will then be outsourced.   Awasthi claims that her managers told her that she should not be celebrating Thanksgiving because she is Indian, and they insisted that she work on Thanksgiving Day.

Infosys management also allegedly harassed Awasthi and her children for celebrating Thanksgiving and called them derogatory terms such as “ABCD,” which stands for “American-Born Confused Desi,” which is used to mock people of Indian ancestry who identify with and have integrated into American culture.

    Good for Promila Awasthi standing up against narrow minded losers like that.

    I’ve been called Coconut and ABCD cause I resemble that Kumar character. In fact, I grew up in California before all the new arrivals came over.

    Within India, Punjabi people, like the Great Khali don’t act like this.

  2. Promila should’ve visited the India offshore centers of these “low-cost” IT companies. If she’d how her colleagues and fellow industry mates (big or small companies) are treated under unbelievable work terms – she would’ve refrained from filing a lawsuit.

    Anyhow, all the best Promila! Atleast the democracy in US gives you the freedom to fight for your rights. Here in India, people would laugh at lawsuits for such reasons and ask you to continue your slavery!!

  4. Yeah right ! As an Indian who has worked in the Fremont office, I have seen how these US born Indians behave. They refer to the Indian engineers as Fresh off the Boat and have this rabid superiority complex among themselves that they arrived years earlier ! Refer to the comment here by an ‘ABCD’…yes…you guys deserve such names…who takes pride that he grew up in california long back before the new arrivals came ! Well..the new arrivals are educated, college grads who are globally competitive…not descendants of truckers and illegal migrants who jumped off from containers !

    I am an American of Indian descent and I have great respect for those who manage to flee the poverty of their home countries for the freedoms and opportunities offered in the United States.

    That being said, Indians who are lucky enough to come here should understand more about what makes the US the beacon of liberty and learn to adopt the values that made America the land of opportunity for all.

    Can’t we all get along!

  6. Infy is Hostile to All

    It’s not just the Indians. Those of us who US citizens of other nationalities also experience a hostile work environment at Infy where we are expected to work on our holidays but are not compensated in $$ or time. Indian men (both born in India and the US) acting in a passive/aggressive manner towards white women; to the point of blatantly ignoring directives or slowing work.
